Amidst the escalating tensions surrounding the Israel-Gaza conflict, Ben & Jerry’s has initiated legal proceedings against its owner, Unilever, alleging that it was prevented from discussing the plight of Palestinian refugees.
The iconic ice cream brand is challenging Unilever, asserting that the conglomerate attempted to silence its statements supporting peace and human rights efforts, as reported by the Telegraph. This legal move claims a violation of a prior agreement, wherein Unilever recognized Ben & Jerry’s independent authority over its social mission.
In a lawsuit filed in New York, Ben & Jerry’s alleges that on four separate occasions, its attempts to publicly advocate for peace and human rights were stifled by Unilever. The brand sought to express solidarity with a ceasefire, encourage UK leaders to ensure safe passage for Palestinian refugees to Britain, support students protesting civilian casualties in Gaza, and request the cessation of US military assistance to Israel.
The recent lawsuit reflects an ongoing friction between Ben & Jerry’s and its parent company over various social and human rights issues. Back in 2021, Ben & Jerry’s took a stand by declaring its intention to cease ice cream sales in areas of Palestine occupied by Israelis, notably the West Bank and East Jerusalem. Although Unilever later sold the Israeli business rights to a local operator allowing sales under different branding, the decision led to further legal disputes which were eventually settled. Political activism remains a significant element of Ben & Jerry’s identity, with its co-founder, Ben Cohen, having previously faced arrest in Washington for protesting in support of Julian Assange.
Both Unilever and Ben & Jerry’s have been approached for their comments in light of the new lawsuit.
